These terms apply to buying and using Miládka on miladka.cz. The seller and operator is Evermind Technologies s.r.o., Company ID 30120209, registered office Vladislavova 1390/17, 110 00 Prague 1, Czech Republic, registered in the Commercial Register kept by the Municipal Court in Prague, section C, file 457550 ("we"). We are not VAT registered; prices are final. You can reach us at info@miladka.cz.

1. What you buy

Miládka is a software assistant that runs on your computer on top of Claude Code. You buy digital content: the installation package, documentation and an installation guide, which you download in the customer portal after payment. Miládka runs on your machine and stays yours after purchase; it keeps working without a subscription.

To run it you need your own Claude subscription (Pro or Max) from Anthropic, a computer with Windows or macOS and an internet connection. The Claude subscription is not part of the price and is governed by Anthropic's terms. We are not responsible for its availability, price or changes.

The Miládka subscription is an optional add-on service: add-ons, new versions and help with installation and operation. It is monthly or yearly.

Custom installation is a one-off service where we install and set up Miládka with you remotely. Company licences for several users are agreed individually; these terms apply accordingly.

2. Order and contract

You place an order with the button on the website and pay by card through Stripe. The contract is concluded on payment. We send the order confirmation and invoice by e-mail to the address you entered. Your customer portal account is created for that e-mail address.

Prices are shown in Czech crowns, euros or dollars as you choose. The introductory price applies until further notice; what you bought at the introductory price stays yours regardless of later price changes.

3. Delivery

The installation package is available for download in the customer portal immediately after payment. Downloads are limited by number of attempts (one by default, see the portal). If a download fails, write to us and we will reset it. The package comes in Czech and English; you choose the version when downloading.

4. Licence

On payment you receive a non-exclusive, perpetual licence to use Miládka for your own needs, or for the agreed number of users under a company licence. The licence is personal: you may not resell, rent, publicly distribute or hand the package or its parts to third parties.

You may modify and extend Miládka for your own use. Copyright in Miládka, the documentation and the add-ons remains ours.

5. Subscription

The monthly subscription has the first month free, then it is charged monthly in advance to the card used at purchase. You can cancel at any time in the customer portal or by e-mail; after cancellation it runs until the end of the paid period and is not charged again. The yearly subscription is paid in advance for 12 months and renews unless cancelled before renewal. We inform you about subscription price changes by e-mail at least 30 days in advance; you can cancel before the change takes effect.

Miládka keeps working without a subscription. You only lose new add-ons, new versions and our help.

6. Withdrawal

If you are a consumer, you may withdraw from the contract within 14 days of concluding it without giving a reason, as long as we have not started performing. The installation package is digital content not supplied on a tangible medium: by downloading it, which you expressly consent to at purchase, performance begins and the right of withdrawal lapses (Section 1837(l) of the Czech Civil Code). Until you have downloaded the package you may withdraw; write to info@miladka.cz and we will refund you within 14 days by the same payment method.

For a subscription you may withdraw within 14 days of taking it out. The monthly subscription has a free first month, so nothing is charged before then. For a yearly subscription we refund the amount paid if you withdraw within 14 days; later the subscription is simply cancelled at the end of the paid period.

For custom installation the right of withdrawal lapses once the installation is completed, which happens with your express consent.

Businesses (purchases with a company ID) have no statutory right of withdrawal. Still, write to us if something is wrong and we will work it out.

7. Defects

We are responsible for Miládka and the documentation matching the description on the website at the time of purchase. Miládka runs on third-party tools (Claude Code, Claude, connected services) that change outside our control. When something stops working because of such a change, we ship the fix in a new version; subscribers receive it automatically. Report a defect to info@miladka.cz or podpora@miladka.cz, ideally with a description of what happened. We handle complaints within 30 days.

We are not responsible for outputs Miládka produces with a language model. They are suggestions that you check and are responsible for. Miládka is not legal, tax or other professional advice.

8. Your data

Miládka runs on your computer. Your notes, mail and documents stay with you and are not sent to our server. What you give Miládka to process goes to Claude under Anthropic's terms. You grant access to mail, calendar and other services yourself and can revoke it at any time. How we handle the data we hold about you (account, payments, support) is described in the Privacy Policy.

9. Termination and changes

In case of a serious breach of these terms (especially distributing the package to third parties) we may close your account and end the subscription. We may change these terms; the new version applies from the date stated at the top and to purchases made from that date. Subscribers are informed of changes by e-mail.

10. Disputes

The contract is governed by Czech law. Consumers may submit a dispute for out-of-court resolution to the Czech Trade Inspection Authority (www.coi.cz) or use the platform at ec.europa.eu/consumers/odr. Data protection is supervised by the Czech Office for Personal Data Protection.

The Czech version of these terms prevails; the English version is a translation.
